Important Payment & Refund Policy
By engaging our services, you agree to 100% upfront payment before project commencement. All payments are non-refundable once work has begun. Please review our payment terms carefully before proceeding.
1. Agreement to Terms
By accessing or using the services provided by Infodots Digital, LLC(doing business as "Healthcare Web Designs"), a New York Limited Liability Company ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms apply to all visitors, users, and clients who access or use our website and services.

3. Services Description
Infodots Digital, LLC provides HIPAA-compliant web design, development, and related digital services for healthcare professionals and organizations. Our services include but are not limited to:
- Custom website design and development
- HIPAA-compliant hosting and maintenance
- Search engine optimization (SEO)
- Online booking system integration
- Patient portal development
- Content creation and management
- Logo design and branding
- Ongoing support and maintenance
4. HIPAA Compliance
We are committed to full HIPAA (Health Insurance Portability and Accountability Act) compliance for all applicable services. HIPAA compliance is critical in healthcare web design as it protects sensitive patient information and ensures your practice meets federal regulatory requirements. As a business associate, we will:
- Execute a Business Associate Agreement (BAA) with all clients handling Protected Health Information (PHI)
- Implement appropriate administrative, physical, and technical safeguards to protect PHI
- Use SSL/TLS encryption for all data transmission and AES-256 encryption for data at rest
- Report any security incidents or breaches within 24 hours of discovery
- Ensure all subcontractors and third-party vendors also comply with HIPAA requirements
- Maintain comprehensive documentation of our compliance efforts and security measures
- Conduct regular security assessments and vulnerability testing
Clients are responsible for ensuring their own HIPAA compliance and for properly using the tools and systems we provide. We provide guidance and documentation to assist with your compliance obligations.
5. Payment Terms
100% Upfront Payment Required
Full payment is required before any work begins on your project. This ensures commitment from both parties and allows us to allocate the necessary resources to deliver your project on time. No work will commence until payment is received and confirmed.
No Refunds Policy
All payments are non-refundable once work has begun. By making payment and engaging our services, you acknowledge and agree that:
- •No refunds will be issued under any circumstances after project work has commenced
- •Project abandonment by the client does not entitle them to any refund
- •Changes in business circumstances or decisions do not qualify for refunds
- •Dissatisfaction with design direction during the revision process is not grounds for a refund; we will work with you through the included revision rounds
Accepted Payment Methods
We accept the following payment methods for your convenience:
- All major credit cards (Visa, Mastercard, American Express, Discover)
- All debit cards
- ACH bank transfers
- Wire transfers (domestic and international)
All payments are processed securely through Stripe. You will receive a detailed invoice and receipt for your records.
6. Project Timeline & Delivery
Project timelines are estimates based on typical project requirements. Actual delivery times may vary based on:
- Timeliness of client feedback and content approval
- Complexity of requested features and customizations
- Volume of revision requests
- Client responsiveness to questions and requests for materials
Delays caused by the client do not entitle them to any refund or compensation. We reserve the right to extend project timelines when client delays exceed 14 days.
7. Intellectual Property
Upon full payment, clients receive ownership of:
- Custom designs created specifically for their project
- Custom code developed for their website
- Content created specifically for their website
- Logo designs (upon full payment)
Infodots Digital, LLC retains ownership of:
- Pre-existing code, templates, and frameworks
- General methodologies, processes, and techniques
- The right to display work in our portfolio (unless otherwise agreed in writing)
8. Client Responsibilities
Clients agree to:
- Provide accurate and complete information for the project
- Provide timely feedback and approvals within 7 business days
- Supply necessary content, images, and materials as requested
- Ensure they have legal rights to use all provided content
- Maintain the security of their login credentials
- Comply with all applicable laws, including HIPAA regulations
- Use the website and services only for lawful purposes
- Make full payment before project commencement
9. Limitation of Liability
To the maximum extent permitted by law, Infodots Digital, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
Our total liability for any claim arising from or relating to these Terms or our services shall not exceed the amount paid by the client for the specific services giving rise to the claim during the twelve (12) months preceding the claim.
10. Warranty Disclaimer
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure. We make no guarantees regarding search engine rankings, patient acquisition, or specific business results.
11. Indemnification
You agree to indemnify and hold harmless Infodots Digital, LLC and its officers, directors, employees, agents, and successors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate services according to the terms of their service agreement. Upon termination:
- No refunds will be issued for work already completed or in progress
- Outstanding payments become immediately due
- We will provide reasonable assistance in transitioning your website (additional fees may apply)
- Confidentiality obligations survive termination
- HIPAA-related obligations continue as required by law
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York County, New York. Both parties consent to the exclusive jurisdiction of such courts.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify clients of material changes via email or through our website. Continued use of our services after changes become effective constitutes acceptance of the modified Terms.
